    Terms of Service

    NPA Notary Finder — A Service of the Notary Public Association

    1. Acceptance of Terms

    These Terms of Service ("Terms") constitute a legally binding agreement between you and NPA Notary Finder, a service of the Notary Public Association ("Company," "we," "us," or "our"), governing your access to and use of the website located at notaryfinder.io and all related services (collectively, the "Site"). By accessing or using the Site, creating an account, or clicking any button indicating acceptance of these Terms, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not access or use the Site.

    These Terms apply to all visitors, users, and others who access the Site, including individuals searching for notary services ("Searchers") and notaries who list their services on the Site ("Notary Members"). We reserve the right to modify these Terms at any time by posting the updated version on this page with a revised Effective Date. Your continued use of the Site following any changes constitutes acceptance of the revised Terms.

    2. Eligibility

    You must be at least 18 years of age to use the Site. By using the Site, you represent and warrant that:

    • You are at least 18 years of age
    • You have the legal capacity to enter into a binding agreement
    • You are not prohibited from using the Site under any applicable law
    • All information you provide to us is accurate, current, and complete

    Notary Members additionally represent and warrant that they hold a valid, current notary public commission in the state or states in which they offer services, and that they will maintain such commission for the duration of their listing on the Site.

    3. User Accounts

    3.1 Account Creation

    To access certain features of the Site, you may be required to create an account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information and for updating it as necessary.

    3.2 Account Security

    You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately at the contact information provided in Section 17 if you become aware of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

    3.3 One Account Per User

    Each individual or business entity may maintain only one active account on the Site. Creating multiple accounts to circumvent a suspension or for any other purpose is strictly prohibited and may result in permanent termination of all associated accounts.

    3.4 Account Termination by User

    You may terminate your account at any time by using the account deletion feature within your account settings or by contacting us at support@notarypublicassociation.org. Upon account deletion, your profile will be immediately removed from the public directory, all message records associated with your account will be permanently deleted, and your active subscription will be canceled. Termination does not entitle you to any refund of prepaid subscription fees except as required by applicable law. Billing records are retained separately in accordance with our data retention obligations.

    3.5 Account Suspension or Termination by NPA Notary Finder

    We reserve the right to suspend or terminate any account at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise inappropriate. Upon suspension or termination, your access to the Site and its features will be immediately restricted. If your account is suspended, you may contact us to appeal the suspension. We will review appeals in good faith but are not obligated to reinstate suspended accounts. No refund will be issued for any remaining unused portion of a subscription period in the event of termination for cause.

    4. Notary Member Terms

    4.1 Listing Requirements

    By creating a Notary Member account and listing your services on the Site, you represent, warrant, and agree that:

    • You hold a valid, active notary public commission issued by the appropriate state authority in each state in which you offer services
    • All information provided in your profile, including your name, contact information, service area, credentials, and pricing, is accurate, truthful, and not misleading
    • Your listing on this Site is based solely on your own self-representation of your credentials. NPA Notary Finder does not verify, certify, or independently confirm your commission status, credentials, insurance, or qualifications, and bears no responsibility for any inaccuracy or misrepresentation in your profile
    • You will promptly update your profile to reflect any changes to your commission status, expiration date, credentials, insurance, or contact information
    • You will not impersonate another notary or misrepresent your qualifications
    • You will comply with all applicable federal, state, and local laws governing notarial acts and professional conduct in every jurisdiction in which you operate
    • You will respond to client inquiries in a professional and timely manner
    • You are solely responsible for ensuring that your commission, insurance, and any required bonds are current and valid at the time of every notarial act you perform

    4.2 Profile Content

    Notary Members are solely responsible for all content uploaded or included in their profile, including but not limited to photos, descriptions, service listings, and credentials. By submitting content to the Site, you grant NPA Notary Finder a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content solely for the purpose of operating and promoting the Site and directory. You represent and warrant that you own or have the necessary rights to all content you submit, and that such content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

    4.3 Subscription and Billing

    Access to the Notary Member listing features of the Site requires a paid subscription. NPA Notary Finder currently offers the following subscription plans:

    • Monthly Plan: $15.00 per month, billed monthly
    • Annual Plan: $144.00 per year ($12.00 per month), billed annually

    AUTOMATIC RENEWAL NOTICE: Your subscription will automatically renew at the end of each billing period (monthly or annually, based on the plan you select) at the then-current subscription rate, until you cancel. You may cancel at any time through your account settings before your next renewal date. Cancellation takes effect at the end of your current billing period — you will retain access to paid features through the end of the period for which you have paid. Subscription fees are non-refundable except as required by applicable law. By subscribing, you authorize NPA Notary Finder to charge your payment method on a recurring basis until you cancel.

    We reserve the right to modify subscription fees upon 30 days written notice to your registered email address. If you do not cancel prior to the effective date of a price change, your continued use of the service constitutes acceptance of the new pricing.

    4.4 Refund Policy

    Subscription fees are non-refundable in all circumstances, including cancellation before the end of a billing period, unused features or services, and partial billing periods of any duration, except as expressly required by applicable law. We reserve the right to issue refunds or credits at our sole discretion on a case-by-case basis in the event of a documented billing error. A billing error is distinct from dissatisfaction with the service and does not entitle you to a refund. For complete details, please review our Cancellation Policy.

    4.5 Notary Member Conduct

    As a Notary Member, you agree not to:

    • Provide false, misleading, or fraudulent information in your profile or in communications with Searchers
    • Misrepresent your commission status, expiration date, credentials, insurance, or qualifications at any time
    • Engage in unprofessional, harassing, abusive, or discriminatory conduct toward Searchers or other users
    • Use contact information obtained through the Site for unsolicited marketing or spam
    • Charge fees that are prohibited or capped under your state's notary laws
    • Attempt to circumvent the Site's systems to obtain services without paying applicable fees
    • Use the Site to solicit Searchers for services outside the scope of notarial acts without appropriate disclosure

    4.6 Scope of Notarial Services

    NPA Notary Finder currently supports listings for the following notarial service categories only: general notary services, mobile notary services, loan signing agent services, real estate document notarization, apostille services, estate planning document notarization, and immigration document notarization.

    Remote Online Notarization (RON) services are not currently supported on this platform. Notary Members may not advertise, list, or represent that they offer RON services through their NPA Notary Finder profile. NPA Notary Finder makes no representations regarding the availability, legality, or requirements of RON services in any jurisdiction.

    Notary Members are solely responsible for ensuring that all services they list and perform comply with the laws and regulations of the state or states in which they are commissioned and operating. Notary regulations vary by state, and NPA Notary Finder does not represent that use of this platform ensures compliance with any particular state's notary laws.

    5. Searcher Terms

    5.1 Use of the Directory

    Searchers may use the Site to locate notary services in their area. The Site provides directory listings as a convenience only. NPA Notary Finder does not endorse, recommend, or guarantee the quality, credentials, professionalism, or conduct of any Notary Member listed on the Site.

    5.2 Contact Form Submissions

    When you submit a contact form through the Site to reach a Notary Member, you acknowledge and agree that:

    • Your submitted information, including your name, email address, phone number, and message, will be shared directly with the Notary Member you are contacting
    • NPA Notary Finder is not a party to any agreement entered into between you and a Notary Member
    • All arrangements, pricing, and services agreed upon are solely between you and the Notary Member
    • NPA Notary Finder is not responsible for the actions, omissions, or professional conduct of any Notary Member

    5.3 Independent Verification

    NPA Notary Finder does not verify, certify, screen, or endorse any Notary Member listed on the Site. All Notary Member listings are based solely on self-reported information provided by the notary. You are solely responsible for independently verifying the credentials, commission status, insurance, and suitability of any Notary Member before engaging their services. The availability of verification resources on this Site does not constitute any guarantee or warranty by NPA Notary Finder regarding any notary's qualifications or fitness for any particular purpose.

    6. Prohibited Conduct

    All users of the Site — regardless of account type — agree not to:

    • Use the Site for any unlawful purpose or in violation of any applicable federal, state, or local law or regulation
    • Post, upload, or transmit any content that is defamatory, obscene, fraudulent, threatening, harassing, or otherwise objectionable
    • Attempt to gain unauthorized access to any portion of the Site, other user accounts, or any related systems or networks
    • Use automated tools, bots, scrapers, or similar technologies to access, collect, or index content from the Site without our express written permission
    • Interfere with or disrupt the integrity or performance of the Site or its infrastructure
    • Reverse engineer, decompile, or disassemble any portion of the Site
    • Use the Site to transmit viruses, malware, or any other harmful or malicious code
    • Impersonate any person or entity or misrepresent your affiliation with any person or entity
    • Collect or harvest personal information about other users without their consent
    • Post false, misleading, or deceptive reviews or ratings of any Notary Member
    • Use the Site to send unsolicited commercial messages or spam
    • Manipulate reviews, ratings, or search results

    7. Reviews and User Content

    7.1 Posting Reviews

    Searchers who have used a notary's services may be invited to leave a review. Reviews must be honest, accurate, and based on a genuine service experience. You agree not to post reviews that are defamatory, fraudulent, abusive, or that contain illegal content.

    7.2 Content Removal

    We reserve the right to remove or modify any user-generated content that violates these Terms or that we deem inappropriate, without prior notice. We are not obligated to monitor all content but may do so at our discretion.

    7.3 Feedback

    If you provide us with any feedback, suggestions, or ideas regarding the Site, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate such feedback into the Site or our services without any obligation to you.

    8. Third-Party Services and Links

    The Site may contain links to third-party websites, services, or resources that are not owned or controlled by NPA Notary Finder, including payment processors and email delivery providers. We have no control over and assume no responsibility for the content, privacy policies, terms, or practices of any third-party services. Your use of any third-party service is at your own risk and subject to that service's own terms and policies. The inclusion of any link on the Site does not imply endorsement, sponsorship, or recommendation by NPA Notary Finder.

    9. Intellectual Property

    9.1 Our Content

    The Site and all of its original content, features, functionality, design, graphics, logos, and software are owned by NPA Notary Finder and the Notary Public Association and are protected by applicable United States and international intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Site without our express prior written permission.

    9.2 User Content

    You retain ownership of any content you submit to the Site. By submitting content, you grant us the limited license described in Section 4.2. You represent and warrant that your content does not infringe any third-party intellectual property rights and that you have all necessary rights to grant us this license.

    10. Disclaimers

    THE SITE AND ALL CONTENT, SERVICES, AND FEATURES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NPA NOTARY FINDER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

    WE DO NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OBTAINED FROM USING THE SITE WILL BE ACCURATE OR RELIABLE.

    NPA NOTARY FINDER IS A DIRECTORY PLATFORM ONLY. WE DO NOT VERIFY, CERTIFY, ENDORSE, SCREEN, OR MAKE ANY REPRESENTATIONS REGARDING THE QUALIFICATIONS, CREDENTIALS, COMMISSION STATUS, INSURANCE, CONDUCT, OR SUITABILITY OF ANY NOTARY MEMBER LISTED ON THE SITE. ALL NOTARY MEMBER LISTINGS ARE BASED SOLELY ON SELF-REPORTED INFORMATION. YOUR USE OF THE SITE AND ENGAGEMENT OF ANY NOTARY MEMBER IS ENTIRELY AT YOUR OWN RISK. NPA NOTARY FINDER IS NOT A PARTY TO ANY AGREEMENT BETWEEN A SEARCHER AND A NOTARY MEMBER.

    11. Limitation of Liability

    TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NPA NOTARY FINDER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00).

    SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

    12. Indemnification

    You agree to defend, indemnify, and hold harmless NPA Notary Finder and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

    • Your violation of these Terms
    • Your use of the Site or any services obtained through the Site
    • Your user content or profile information
    • Your violation of any applicable law or regulation
    • Your violation of any third-party rights, including intellectual property rights or privacy rights
    • Any dispute between you and another user of the Site, including between a Searcher and a Notary Member
    • Any notarial act you perform or fail to perform in connection with a client obtained through the Site

    13. Governing Law

    These Terms and any dispute arising out of or related to them or the Site shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in California for the resolution of any disputes not subject to arbitration under Section 14.

    14. Dispute Resolution

    14.1 Informal Resolution

    Before filing any formal legal claim, you agree to first contact us at the address provided in Section 17 and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving your written notice. If the dispute cannot be resolved informally within that period, either party may pursue formal legal remedies as set forth in this Section.

    14.2 Binding Arbitration

    PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES INDIVIDUAL ARBITRATION OF DISPUTES RATHER THAN JURY TRIALS OR CLASS ACTIONS.

    Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, your subscription, or any services obtained through the Site (collectively, "Disputes") that cannot be resolved through the informal resolution process described in Section 14.1 shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in English and, unless otherwise required by the AAA rules, shall be conducted on a documents-only basis or via telephone or videoconference. If an in-person hearing is required, it shall take place in California, or at such other location as mutually agreed by the parties.

    The arbitrator shall have exclusive authority to resolve all Disputes, including any claim that all or any part of these Terms are void or unenforceable. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own attorneys' fees, costs, and expenses unless the arbitrator determines that a claim was frivolous or brought in bad faith, in which case the arbitrator may award fees and costs to the prevailing party.

    Nothing in this Section shall prevent either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. You also retain the right to bring an individual claim in small claims court if your claim qualifies. If any portion of this arbitration agreement is found to be unenforceable, that portion shall be severed and the remainder of this Section shall continue in full force and effect. If the class action waiver in Section 14.3 is found to be unenforceable, then the entirety of this arbitration agreement shall be null and void.

    14.3 Class Action Waiver

    TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST NPA NOTARY FINDER.

    14.4 Statute of Limitations

    You agree that any claim or cause of action arising out of or related to these Terms or the Site must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred, notwithstanding any statute of limitations to the contrary.

    15. Changes to These Terms

    We reserve the right to modify these Terms at any time. When we make material changes, we will update the Effective Date at the top of these Terms and notify active users via email to the address associated with your account. Non-material changes may be made without notice. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site and may cancel your account.

    16. Survival

    Upon termination or suspension of your account for any reason, the following provisions of these Terms will survive: Section 4.2 (Profile Content license for content already published), Section 9 (Intellectual Property), Section 10 (Disclaimers), Section 11 (Limitation of Liability), Section 12 (Indemnification), Section 14 (Dispute Resolution), and any other provisions that by their nature should survive termination.

    17. General Provisions

    • Entire Agreement: These Terms, together with our Privacy Policy and Cancellation Policy, constitute the entire agreement between you and NPA Notary Finder regarding your use of the Site and supersede all prior agreements, representations, and understandings.
    • Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
    • Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision unless acknowledged and agreed to by us in writing.
    • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
    • Force Majeure: We will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, pandemics, government actions, or failures of third-party service providers.
    • Notices: All notices to us must be sent in writing to the contact information below. We may provide notices to you via email to your registered address or by posting on the Site.
